Our Bulls Don’t Play Around… and Neither Do Our Lawyers... 

Before you hop on and have the time of your life, here’s the important stuff you need to know.

By renting equipment or participating in any activity provided by Tito’s Toros LLC, you acknowledge and agree to the following Terms, Conditions, Safety Rules, and Liability Waiver. These terms apply to all riders, participants, the event host, and guardians of minors.


1. ASSUMPTION OF RISK

Riding a mechanical bull involves significant risk. Injuries may include:
  • Falls, slips, impact injuries

  • Neck, back, or joint injuries

  • Concussions or loss of consciousness

  • Broken bones or musculoskeletal injuries

  • Emotional distress

  • Paralysis or, in rare cases, death

  • Injuries to minors or other guests

These risks cannot be eliminated without endangering the essential nature of the activity.By participating or allowing others to participate, you acknowledge and accept all such risks.

2. HEALTH & PARTICIPATION REQUIREMENTS

Riders must be in good physical health. The following individuals may NOT ride:
  • Pregnant individuals

  • Anyone under the influence of alcohol or drugs

  • Individuals with heart conditions or blood pressure problems

  • Anyone with previous back, neck, joint, or bone injuries

  • Anyone recovering from surgery

  • Individuals unable or unwilling to follow safety instructions

Tito’s Toros staff may deny rides at any time based on safety concerns.

3. SAFETY RULES

All riders and the event host must follow these rules:
  1. Only one rider on the bull at a time

  2. Riders must hold on with one hand

  3. No alcohol, drugs, food, gum, or loose objects while riding

  4. Remove jewelry, hats, sunglasses, belts, sharp objects

  5. No flips, stunts, or dangerous behavior

  6. Stay clear of the bull while in motion

  7. Wait for a complete stop before dismounting

  8. Children under 18 require parental consent

Violation of safety rules may result in immediate termination of use without refund.

4. RELEASE OF LIABILITY

You hereby release, waive, discharge, and agree to indemnify Tito’s Toros LLC, its owners, operators, agents, employees, and contractors from:
  • Any injury or accident caused by participation

  • Injuries to yourself or others

  • Injuries resulting from equipment operation or malfunction

  • Claims related to negligence (except gross negligence or willful misconduct)

  • Property damage caused during your event

This release applies to all participants and guests, including minors.

5. EVENT HOST RESPONSIBILITIES

The event host agrees to:
  • Provide a safe, level, unobstructed setup space (minimum 17 ft x 17 ft)

  • Provide two electrical outlets, one of which must be a dedicated 20-amp circuit, unless renting a generator

  • Ensure guests behave responsibly

  • Prevent intoxicated guests from riding

  • Keep the area free of hazards

  • Maintain crowd control around the equipment

If unsafe conditions arise, Tito’s Toros may halt or cancel service without refund.

6. PHOTO & MEDIA RELEASE

By participating, you grant Tito’s Toros permission to use photos or videos taken at your event for marketing purposes.
If you do NOT want photos taken, notify our staff before the event.


7. PAYMENT, CANCELLATION & FEES

  • Deposits (typically $50–$100) secure your booking and are non-refundable

  • Remaining balance is due at or before delivery

  • Cancellations within 14 days of the event may forfeit partial or full deposit/retainer

  • Fees may apply for:

    • Pet soiling: $50

    • Damaged horns: $50 per horn

    • Damaged/missing tables: $65 each

    • Damaged/missing chairs: $15 each


8. EQUIPMENT OPERATION POLICY (STAFF-OPERATED AND SELF-OPERATED MODELS)

Tito’s Toros offers two distinct operation models:


A. STAFF-OPERATED MODEL

Under this model:
  • Only Tito’s Toros personnel may operate the mechanical bull

  • Riders must follow all operator instructions

  • Staff may refuse or stop any ride for safety reasons

  • The event host must maintain safe conditions around the equipment


B. SELF-OPERATE / DROP-OFF MODEL (Client Operates the Bull)

Available for residential or private-home events.

1. Mandatory ID VerificationThe designated operator ("the Client") must present a valid government-issued ID with an address matching the event location.
If ID does not match, Tito’s Toros may refuse delivery.

2. Mandatory Safety TrainingBefore equipment is released:
  • The Client receives full hands-on instruction on safe operation

  • The Client must demonstrate understanding and comfort

  • Only the trained Client may operate the bull

  • No other individual may adjust controls or operate equipment


3. Acceptance of All RisksThe Client acknowledges that this activity involves known and unanticipated risks, including:
  • Being thrown

  • Head, neck, or back injuries

  • Emotional or physical injury

  • Injuries to minors or other guests

  • Paralysis or death

The Client chooses to participate voluntarily, accepting all risks even if caused by negligence.
4. Operator Sobriety RequirementThe Client agrees to operate the bull sober, without:
  • Alcohol

  • Drugs

  • Any judgment-impairing substances

Operation must stop immediately if impairment occurs.
5. Responsibility for All Riders & GuestsThe Client:
  • Accepts full responsibility for every rider

  • Accepts responsibility for minors participating

  • Agrees to enforce all safety rules

  • Acknowledges they may not know every participant’s medical limitations

Despite this, the Client assumes full responsibility for all riders.
6. Release of Liability & IndemnificationThe Client agrees to:
  • Release Tito’s Toros from all claims connected to participation

  • Indemnify Tito’s Toros for claims arising from guest injuries

  • Accept liability even for claims alleging negligence

  • Pay attorney fees if Tito’s Toros must enforce this agreement


7. Equipment Damage & Financial ResponsibilityThe Client agrees to protect the equipment and accepts responsibility for:
  • Damage to bull, jumper, or control panel

  • Theft or loss of components

  • Replacement costs up to $9,000

  • Additional fees for soiling, damaged horns, tables, chairs

Repairs due to misuse or negligence will be billed to the Client.
8. Insurance & Medical ResponsibilityThe Client certifies they have adequate insurance or agree to pay out-of-pocket for injuries or property damage.The Client further accepts all risks related to:
  • Pre-existing health conditions

  • Medical expenses of injured guests or minors

  • Emotional distress or wage loss resulting from injuries


9. Legal JurisdictionAll legal claims must be filed solely in the State of California.If any clause is deemed unenforceable, the remaining clauses remain valid.
10. Acknowledgment of UnderstandingBy signing the Self-Operate Waiver, the Client acknowledges:
  • They had sufficient time to read the entire document

  • They understand and agree to all terms

  • They voluntarily assume responsibility for themselves and all guests

Equipment will not be left at the event location unless this waiver is signed.

9. PRIVACY POLICY

Tito’s Toros collects customer information strictly for communication, scheduling, and operational purposes.
We do not sell or share personal data except as required to provide services.
Information may include:
  • Name

  • Address

  • Phone

  • Email

  • Event details

You may request deletion of your data at any time.

10. SEVERABILITY & LEGAL NOTICE

If any part of this agreement is found invalid, the remainder shall remain fully enforceable.
